No criminal charges against Milwaukee Co. mental health workers in patient death

MILWAUKEE (WTAQ) - No criminal charges will be filed against employees at the Milwaukee County Mental Health Complex in connection with the death of a patient last October.

Assistant District Attorney Mark Williams said more should have been done to help 25-year-old Brandon Johnson. But Williams said the lack of action did not reflect criminal activity.

A state law was changed in 2010, which forces prosecutors show an actual intent to harm a patient.

Williams said the workers’ behavior was “neglectful” but it did not, “rise to the level of bad faith.”

Johnson complained of paralysis in his legs after arriving at the mental health complex – but he said staffers did not believe him, and did nothing. Johnson later died from a broken neck and genetic blood clots.

Williams said it’s possible that Johnson broke his neck after he fell onto the floor of his room when he tried kicking out a window.
