Closing arguments made in Paape trial


SHEBOYGAN, WI (WHBL) - The fate of Nathan Paape is now in the hands of a jury at the Sheboygan County Courthouse.  Following the end of testimony yesterday, closing arguments were made this morning.

DA Joe DeCecco, speaking for the state, called the murder of 78-year-old Barbara Olsen a killing frenzy.  He said the boys charged for the murder, Paape and 14-year-old Antonio Barbeau, both knew exactly what they were doing when they went into Olsen’s house.  He added Paape had many opportunities to get out of the situation, but he did not.

Defense attorney June Sporel said Paape is a passive person, a follower.  She added her client thought Barbeau was joking when he talked about robbing and killing his great-grandmother.  She did concur that Nathan was not innocent of the murder, but he is not guilty of first degree murder.  If anything, he is guilty of that lesser offense. 

The jury of nine men and three women were given an option by Judge Timothy Van Akkeren that they could find Paape guilty of a lesser offense of felony murder if they cannot come to an agreement of a conviction of first degree murder.
