Judge rules man cleared of murder charges must stay in prison

RACINE, WI (WTAQ) - A Racine County Court judge says a man must remain behind bars, despite murder charges being dismissed.

32-year-old Xavier Rockette was convicted of first-degree murder in 2003, sentenced to 35 years in prison. He served over a decade of that sentence.

However, the charge was dismissed when one of the prosecution’s witnesses allegedly lied during testimony.

Despite the dropped charge, the circuit judge says Rockette must serve a charge of recklessly endangering safety until next spring.
